Application Summary
Overview
Fox Solar LLC (Fox Solar or the applicant), wholly-owned subsidiary of Nextera Energy Resources LLC, is seeking approval to construct a solar energy generating facility with a generating capacity of 100 MWac (megawatt alternating current) plus a 50 MW battery energy storage system (BESS) in the Town of Morgan in Oconto County. The entire project study area that was evaluated is approximately 1,148 acres, of which, the proposed facility area makes up 512.8 acres, and the alternative facility area makes up 136.1 acres. The project collection substation, BESS, and operation and maintenance building would require approximately 4 acres that are factored into the 512.8 acres of the proposed facility area. The major components of the project include solar photovoltaic (PV) panels, power conversion units (transformers and inverters), approximately 11.9 miles of underground 34.5 kilovolt (kV) collector circuits for the proposed facilities (2.1 miles for the alternative facilities), a new 138 kV collection substation, a new 138 kV gen-tie transmission line of approximately 950 feet (0.18-mile) in length connecting the project collection substation to the existing ATC-owned Morgan Substation, and an operation and maintenance building. Fox Solar is seeking a Certificate of Public Convenience and Necessity (CPCN) and all other approvals required to construct the 100 MWac solar project, gen-tie line, BESS, project substation, and other necessary related facilities.

This project is proposed by an independent power producer. Therefore, the Commission does not review the project cost. The cost to Wisconsin utilities, and ratepayers, would be reviewed if the facility or power from the facility is purchased by Wisconsin utilities.

The applicant proposes to construct this project in the Town of Morgan, Oconto County, Wisconsin.
Proposed Schedule
- The applicant submitted the application to the Commission in June 2025.
- If approved, the applicant anticipates construction for this project to begin in Q3 2027 with an estimated completion date of Q4 2028.
The proposed project is categorized as a
Type II action under Wis. Admin. Code § PSC 4.10(2). The Commission will prepare an Environmental Assessment (EA) for this project that will evaluate the location of the project and its potential environmental, community, and private property impacts. There will be a preliminary determination when the EA is complete that will determine whether the preparation of an Environmental Impact Statement (EIS) is necessary.
