Annual Filing Requirements for CLECs and Resellers

Competitive Local Exchange Carriers (CLECs)

What are CLECs required to do?

CLECs must:

  • Inform the Commission of changes in information submitted on the original petition.
  • File annual reports for assessment purposes.
  • Respond to data requests issued by PSC staff.
  • Abide by the rules regarding notice of changes in rates and terms of subscription in Wis. Admin. Code § ATCP 123.04.
  • Comply with all statutes specified as applicable by the CLEC and certification order.

Resellers

What are Resellers required to do?

Resellers must:

  • Inform the Commission of changes in information submitted on the application form.
  • File annual reports for assessment purposes.
  • Respond to data requests issued by PSC staff.
  • Abide by the rules for resellers promulgated by the PSC in Wis. Admin. Code ch. PSC 168.
  • Abide by the rules regarding notice of changes in rates and terms of subscription in Wis. Admin. Code § ATCP 123.04.

CLECs and Resellers

What is the difference between a CLEC and a Reseller?

Both CLECs and Resellers may operate switches, but only CLECs may operate transmission facilities within Wisconsin.

How should CLECs and Resellers notify the Commission of changes to information, such as name changes, etc.?

If the CLEC or Reseller is changing their official mailing address and/or contact information, it should enter that information via the form on this web page.

For other changes, including changes to the CLECs or Resellers; name, adoption of d/b/a names or other changes, the CLEC or Reseller should upload a letter, signed by a corporate officer or agent who attests that the information is true and correct, to the Electronic Records Filing system (ERF) on the Commission’s website.

All such letters should include the four or five digit PSC Utility ID. If the company is changing its legal name, include the old name, the new name and the effective date of the change in the letter. Attach an electronic copy of the letter to (DFI) approval / acknowledgement.

Is Commission approval required for mergers, transfers in control, or stock transactions?
